    1. Acceptance of Terms

    By accessing or using Command Center's collision repair shop management platform (the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users, including shop owners, managers, employees, and any other individuals granted access.

    2. Description of Service

    Command Center provides a cloud-based platform for collision repair shop management, including but not limited to scheduling, repair order management, technician time tracking, production boards, digital check-in, AI-powered insights, reporting, payment processing, and integrations with third-party estimating systems. Features available to you depend on your selected subscription plan.

    3. Account Registration

    • You must provide accurate, complete, and current information when creating an account.
    • You are responsible for maintaining the confidentiality of your account credentials.
    • You are responsible for all activities that occur under your account.
    • You must notify us immediately of any unauthorized use of your account.
    • You must be at least 18 years of age to create an account.

    4. Free Trial

    We offer a 14-day free trial for all subscription plans. A valid payment method is collected at signup, but nothing is charged during the trial. If you do not cancel before the trial period ends (Day 15), your selected plan will automatically begin and your payment method will be charged the one-time setup fee together with your first monthly (or annual) charge. You may cancel at any time during the trial period at no cost.

    5. Subscription & Billing

    • Plans: We offer Starter and Pro plans, billed monthly or annually. Plan details and pricing are listed on our pricing page.
    • Setup Fees: A one-time setup fee applies to each plan as indicated at the time of purchase.
    • Renewals: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
    • Price Changes: We may adjust pricing with at least 30 days' written notice. Changes take effect at the start of your next billing cycle.
    • Refunds: Setup fees are non-refundable. Monthly subscription fees are non-refundable for partial months. Annual plans may be eligible for a prorated refund if cancelled within the first 30 days.

    6. Multi-Location Add-Ons

    Additional shop locations may be added for a one-time setup fee of $500 per location. Multi-location features are available on the Pro plan. Contact our sales team for custom multi-shop operator arrangements.

    7. Acceptable Use

    You agree not to:

    • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
    • Attempt to gain unauthorized access to any part of the Service or its related systems.
    • Interfere with or disrupt the integrity or performance of the Service.
    • Reverse engineer, decompile, or disassemble any aspect of the Service.
    • Resell, sublicense, or redistribute access to the Service without written authorization.
    • Upload malicious code, viruses, or any harmful content.

    8. Data Ownership

    You retain ownership of all data you input into the Service ("Your Data"). By using the Service, you grant us a limited license to process, store, and display Your Data solely for the purpose of providing the Service. We will not use Your Data for any other purpose without your consent. You may export Your Data at any time through the Service's export functionality.

    9. Third-Party Integrations

    The Service may integrate with third-party services such as estimating systems (CCC ONE, Mitchell, Audatex), accounting software (QuickBooks, Xero), and payment processors (Stripe). Your use of third-party services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

    10. Service Availability

    We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data loss, or damages resulting from service interruptions beyond our reasonable control.

    11. Intellectual Property

    The Service, including its design, features, code, documentation, and branding, is the exclusive property of Command Center and is protected by intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property except the limited right to use the Service as described herein.

    12. Limitation of Liability

    To the maximum extent permitted by law, Command Center shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

    13. Indemnification

    You agree to indemnify and hold harmless Command Center, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

    14. Termination

    Either party may terminate the subscription at any time. Upon termination, your access to the Service will be revoked at the end of the current billing period. We reserve the right to suspend or terminate your account immediately for violation of these Terms. You may request a data export within 30 days of termination.

    15. Modifications to Terms

    We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the revised Terms.

    16. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
